Activist Sues FG Over Character Commission Boss’ Appointment

A Civil Society Activist, Comrade Hassan Isah, has filed a suit at the Federal High Court, Abuja against President Goodluck Jonathan, Secretary to the Government of the Federation (SGF), Attorney-General of the Federation, Prof. Shuaibu Oba Abdulraheem and Alhaji Mohamed Ari Gwarska, challenging the purported re-instatement of Abdulraheem as the Chairman of the Federal Character Commission (FCC)
In an affidavit in support of the Originating Summons filed yesterday at the Federal High Court in Abuja, the Plaintiff, Isah alleged that the 5th defendant, on December 13, 2010, forwarded a letter to the 1st and 2nd defendants, resigning his position as the then Chairman of the 4th defendant to enable him contest for a political position in Kwara State.
He also said that the 1st and 2nd defendants, on January 5, 2011, wrote a letter with reference number SGF.19/S.51/7/692 accepting the resignation of the 5th defendant and directing that the said resignation took effect from January 3, 2011 and that the 5th defendant handed over to the 6th defendant as the Acting Chairman of the 4th defendant.
Comrade Hassan Isah further alleged that the 5th defendant was paid all his entitlements and emoluments after his resignation as the Chairman of the 4th defendant, stressing that he, however, failed in his bid to secure the political position he sought to contest.
Saying that the 1st and 2nd defendants purportedly wrote a letter of withdrawal of resignation and purportedly re-instated the 5th defendant as the Chairman of the Federal Character Commission, the plaintiff stated that he knew that the 5th defendant had ceased from holding the position of the Chairman of the Commission as from the Dec. 13, 2010 after he was paid all his entitlements and emoluments as the former Chairman of the Commission.
He further argued that the name of the 5th Defendant was never sent to the Senate of the Federal Republic of Nigeria before his purported re-instatement, adding that he was never presented before the National Assembly for approval or confirmation.
The plaintiff, however, asked the Court to intervene so that the defendants would not breach the provisions of the Constitution and the Federal Character Act.
