Forgery: Court Rejects Evidence Against Suswam

A Federal High Court in Makurdi, Benue State, yesterday, rejected the evidence tendered before it by one Mr. Terver Kakih against Governor Gabriel Suswam in a forgery case and said that it was not certified.

Kakih had contested for Benue State Governorship ticket with Governor Suswam in the last April, 2011 general election primaries on the platform of the Peoples Democratic Party (PDP).

He presented photocopies of the West African Examination Council (WAEC) results of Governor Suswam of 1981 and 1982, also tendered Form CF 001, which he said was released by the Independent National Electoral Commission (INEC).

Cross examined by his lawyer, Mr. S A Orkuma, Kakih said he deemed Suswam non-qualified to have contested the PDP ticket with him because of the non-certification of his INEC form and WAEC results.

He claimed to have sourced the evidence from WAEC and INEC and that he wrote to INEC for the first time requesting the form CF 001 submitted by Suswam. INEC replied him and gave him the form which he told the court his lawyer disapproved of because it was not a true and certified copy.

He further narrated that, he (Kakih) wrote again to INEC who he admitted gave him another certified form of his opponent (Suswam) but that the last two pages that contained Suswam’s WAEC result were now removed from the form.

Lawyer to INEC, Mr. J S Okutepa (SAN), prayed the court to reject the evidence presented by Kakih, the development he referred to been contrary to section 104 (2) of the Evidence Act 2011.
